We will do our utmost to ensure that availability of the web site will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Your access to the web site may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. The website or any portion of this web site may not be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose without the express written consent of Associated Calibration & Training Ltd.

Your conduct

You must not use the web site in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way. You are responsible for all electronic communications and content sent from your computer to us and you must use the web site for lawful purposes only. You must not use the website for any of the following:

  • For fraudulent purposes, or in connection with a criminal offence or unlawful activity
  • To send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy, or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters mass mailings or any “spam”
  • To cause annoyance, inconvenience or needless anxiety

General

Orders will only be accepted and processed in accordance with the terms and conditions set out on this page. By placing an order with Associated Calibration & Training Ltd you are accepting these terms of sale. Customer’s terms and conditions will only be accepted where agreed in our quotation.

 

Validity

Orders are open for acceptance within 30 days from the date of issue on our quotation unless otherwise stated in the quotation.

 

Order Acceptance

Orders will be accepted and processed once sufficient information has been received. This will include an official order number on the customers headed paper, clear details of the items required and reference made to any quotations against the order is matched. Instructions that fall outside of these requirements will be the subject to a revised offer following a review of the instructions sent.

 

Pricing and availability

Whist we endeavour to complete orders quickly we are at the disposal of our suppliers. We will accept no responsibility for loss due to delayed delivery. We will provide despatch information or an estimated delivery date. Estimates are just that they are not guaranteed despatch times and should not be relied upon as such. Whilst we endeavour to hold sufficient stock to meet all orders, we may have insufficient stock to supply or deliver the goods ordered. If this occurs, we will endeavour to advise you. Whilst every effort is made to ensure the accuracy of prices no responsibility can be accepted for errors or omissions. We will endeavour to give as much notice as possible of any changes in price. All goods are invoiced at the price ruling at the date of shipping. All prices are quoted in UK pounds sterling and are subject to change without notice.

 

VAT

All prices are subject to VAT and subject to changes in taxation. VAT no 776264692. We are not responsible for any other importation taxes or charges that may be levied at the delivery destination. These terms and conditions and all transactions relating to this web site are governed by the laws of England and Wales and are subject to the non-exclusive jurisdiction of the English Courts.

 

Payment

Payment terms are as laid down on the website. Goods will only be shipped on clearance of payment.

 

Hire Terms

  1. Overview

Associated Calibration and Training Ltd (hereinafter also known as “The Company”) provide test equipment hire. The Customer is the company or persons using the services of Associated Calibration and Training Ltd. The services provided are in accordance with the Company’s terms and conditions of sale (available on request) and not that of the Customer. The Company’s terms and conditions will nullify all other terms and conditions received.

  1. Rates / Payment

Hire rates will be as specified as per our website  Meters2U.com or as quoted subject to a minimum period of time of one week or as agreed. All prices exclude VAT, which will be added at the current rate upon invoicing.

The initial payment will be for the first weeks hire and any carriage charges, if applicable. If the equipment is hired beyond this period the Customer will agree to a recurring weekly payment being taken for each subsequent week the equipment is kept, and that this agreement will remain in place for the duration of the hire contract. The recurring weekly card payment also applies to credit accounts opting to make payment by card. If in the instance that the card details which the customer has supplied is cancelled or declined during this agreement, then the customer will provide alternative card details to enable payment for the duration of the hire contract. The Company, at its discretion, reserves the right to request a holding deposit as security, of which the Customer will be informed. This deposit will be refunded following the safe return of the equipment hired.

In cases of payment default, Associated Calibration and Training Ltd is entitled to recover the hired or purchased equipment without notice.

  1. Hire Period

The period of hire commences on the day the equipment is delivered to the Customer, or collected from our office by the Customer, and continues until the equipment is collected by the Company or returned by the Customer to the Company office.

The hire period is one week of seven consecutive days inclusive and includes weekends and bank holidays. The Customer may extend the hire for longer than seven days with the agreement of the Company. The extended hire will be charged on the agreed weekly rate.

  1. Cancellations

Once the hired equipment has been despatched, and prior to delivery, any subsequent cancellation of the order will be subject to a fee of 100% of the agreed weekly hire rate. After delivery the order cannot be cancelled and our minimum hire charge of one week will apply

  1. Responsibility & Eligibility

The manufacturer’s instructions and other regulations of the hired equipment will be observed at all times by the Customer. The Customer shall be entirely responsible for the proper use of the equipment and also shall be responsible for any damage caused to the equipment through failure to observe such instructions or regulations.

It will be the Customer’s responsibility when hiring equipment;

  • Not to subject the equipment to any unfair wear and tear or misuse, and to use the equipment in a proper manner.
  • To preserve the Company’s or the manufacturer’s identification number or mark that may be on the equipment.
  • To keep the equipment safe, free from damage and in good condition whilst it is in the Customers use and possession.
  1. Loss, Theft or Damage

It will be the Customer’s responsibility when hiring equipment;

  • To compensate Associated Calibration and Training Ltd in respect of any loss, theft or damage to the equipment howsoever caused, except for fair wear and tear, and normal use. In the event of any loss, theft or damage, the Customer shall notify Associated Calibration & Training immediately. Associated Calibration & Training Ltd will quote a sum covering the cost of repair including any re-calibration costs. If the equipment or items are lost, stolen or beyond economical repair then a replacement cost including a calibration certificate if applicable will be quoted. Any quoted costs will also include an administration fee. Any loss on income as a result of any such repair or replacement will be paid by the Customer and the normal hire rate shall continue until the full amount is paid to Associated Calibration and Training Ltd.
  • To ensure that valid insurance is in place whilst the equipment is in the Customers possession or is being carried by the Customers use of a third-party courier, to cover for any loss or damage.
  • In the event of the equipment being found defective on receipt or during use the Company must be notified immediately. Replacement or repair of the equipment will be effected with the minimum possible delay.
  • To not hold Associated Calibration and Training Ltd responsible for any loss, damage or injury (including death) to persons or property where the equipment is not used in accordance with our terms and conditions.
  • To not hold Associated Calibration and Training Ltd responsible for direct, indirect or any consequential loss under these terms and conditions.
  • To not hold Associated Calibration and Training Ltd responsible for any loss of data from data logging instruments and devices.

 

Calibration Terms

  1. Overview

The accuracy of a test instrument should be verified and recorded annually or in accordance with manufacturer’s instructions. Test instruments are usually calibrated at least every twelve months and, in some cases, such as gas monitors, this can be six months. ACT provide calibration certificates for each instrument we calibrate. The certificate verifies that the instrument was within calibration parameters at that time only. The certificate does not guarantee that the instrument is fit for purpose at any time after that. Should the equipment under test fail calibration we will provide a quotation for the subsequent repair work required in order to complete the calibration process. Your authority will be sought before we proceed with any extra work.

  1. Item Collection

 Please note that customers are responsible for packing test equipment and labelling the box.

  • Customers requesting the Company to arrange collection are bound by the terms & conditions of DPD regarding the collection transaction.
  • ACT cannot be held responsible for any loss and customers are advised to ensure appropriate insurance cover is arranged prior to collection.
  • Collections requested before 11.00am on any working day will be scheduled for same day pick-up.
  • Collection requests received after 11.00am will be scheduled for pick-up the following working day.
  • We cannot give specific times for collections, our carriers collect during normal office hours of 9.00 am & 5.00 pm.
  • ACT cannot be held responsible for any ensuing delays caused by events beyond our control.
  1. Multiple Item Collections
  • If you require more than one item collecting we advise that you put them in one box.
  • For larger items or multiple box collections simply notify one of our advisers how many boxes are to be collected.
  • Extra charges may apply where more than one box is being collected
  1. Calibration Turnaround Times
  • Our standard turnaround times are three working days from receipt of goods. Wherever possible we will endeaver to meet our agreed turnaround times. The company cannot be held repsonsible for any delays which are beyond our control.
  • Customers requiring an emergency turnaround are advised to contact our offices on (01782) 827018 for immediate assistance.
  1. Calibration Certificates & Other Information
  • Calibration certificates will be emailed to you on completion.
  • Details of your equipment and calibration certificates are kept on our database.
  • ACT will notify you when your calibration is due 4-6 weeks in advance of the calibration due date.

  

Repairs Terms

  1. Repair Authorisation

Repairs will be undertaken following the acceptance of our standard repair charge or written quotation. In most cases we have standard repair charges and these are usually quoted prior to ACT receiving the equipment

  1. Unable to Repair

In the event that we cannot repair your equipment we will offer you the following options;

  • Forward you tester to the appropriate manufacturer for repair at an agreed cost.
  • Return the equipment to you. Please note a £65.00 fee will apply to cover investigation and carriage costs.
  • Scrap the tester. No charges apply.
  • Quote you for a new replacement tester.
  1. Warranty
  • A warranty period of three months is offered on repairs we undertake.
  • Warranty on repairs covers for any failure against the original defect. Unrelated defects which are reported thereafter are not covered under the warranty and subsequent repairs will be quoted extra
  1. Item Collection

  • Details of your equipment and calibration certificates are kept on our database.

Delivery

Where goods are in stock, orders received before 1.00pm, (subject to payment clearance), will be shipped for delivery the following working day. Goods weighing more than 2kg will be shipped via DPD. For goods weighing less than 2kg Royal Mail recorded or special delivery will be used. In either case customers are bound by the terms & conditions of the shipping company used. For goods that are not in stock please allow up to 28 days for delivery.

 

Losses

We will not be responsible for any loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the web site/ our services or when a contract for the sale of goods by us to you was formed.

 

Storage

We reserve the right to charge storage fees If we do not receive shipping instructions within seven days of us notifying you that the goods are ready for despatch. At the end of three months, if no delivery instructions have been received, the goods will be invoiced in full. If after six months we have not received despatch instructions the goods will revert to the property of Associated Calibration & Training Ltd.

 

Amendments to these conditions

We reserve the right to make changes to our website, policies, and these Conditions of Sale at any time. You will be subjected to the policies and Conditions of Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you.) If any of these conditions is deemed invalid, void, or for any other reason unenforceable, that condition will be deemed serviceable and will not affect the validity and enforceability of any remaining condition.

 

Events beyond our control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

 

Loss or damage of goods in transit

In the event of any loss or damage to goods in transit, cover is limited to the terms of the company instructed to deliver the goods. Where goods are shipped via carrier cover will be limited to £120.00 maximum. Customers are advised to make provision for adequate insurance cover for their own equipment. Claims for damage or loss of goods shipped via carrier must be received before 3.00pm the day after the delivery or scheduled delivery date.

 

Cancellation / Refunds

  • Goods may only be cancelled if we have yet to receive the goods from our suppliers. Cancellations should be advised by post or e-mail and include the reasons for cancellation. Where cancellations are made a minimum re-stocking charge of 25% of the total invoice amount applies plus any costs incurred from our suppliers that we cannot otherwise recover.
  • In the event of an on-site calibration visit being cancelled within 48 hours of taking place the company will charge 100% of the calibration fee.
  • In the event of a training course being cancelled within 48 hours of taking place the company will charge 100% of the course fee.
  • Where a refund is authorised please allow up to 28 days for processing.
  • Where goods are faulty the manufacturer’s warranty terms shall apply. Manufacturer’s warranties may vary from product to product. Faulty goods shall be returned to the original supplier for repair / rectification and returned to the customer once complete.

 

Privacy

The privacy of all our customers is extremely important to us. We do not store credit card details nor do we share customer details with any 3rd parties. Associated Calibration and Training Ltd complies with the Data Protection Act 1988.

 

Legal Construction

Any contract entered into shall operate as an English contract and conform to English Law.

 

Title and Risk

All goods shall remain the property of Associated Calibration & Training Ltd until payment of all invoiced amounts is made in full. All risk in the goods shall be borne by the customer from the point of despatch to the destination. The customer must make insurance arrangements to the full value of the goods at risk.
